These Terms of Use (the “Terms”) govern your access to and use of friendsofjamesmcqueen.com (the “Site”), operated by Friends of James McQueen (the “Campaign,” “we,” “us,” or “our”). By using the Site you agree to these Terms. If you do not agree, do not use the Site.
1. Eligibility
You must be at least 13 years old to use the Site. By using the Site you represent that you meet this requirement.
2. Permitted Use
The Site is provided for personal, non-commercial informational use about the Campaign. You agree not to:
- Use the Site in any unlawful manner or for any unlawful purpose.
- Interfere with or disrupt the Site, its servers, or networks connected to it.
- Attempt to gain unauthorized access to any portion of the Site, related systems, or other users’ accounts.
- Use any robot, scraper, or other automated means to access the Site, except for public search-engine indexing.
- Submit false, misleading, or fraudulent information through any form on the Site.
- Impersonate any person or entity, or misrepresent your affiliation with any person or entity.
- Harvest or collect information about other visitors without their consent.
3. User Submissions
When you submit content to the Campaign through the Site (for example, through the contact form or by signing up for updates), you grant the Campaign a non-exclusive, royalty-free, perpetual, worldwide license to use, store, copy, and display that content for Campaign purposes, including responding to your inquiries, sending updates, complying with legal obligations, and improving our operations. You confirm that your submissions do not infringe any third party’s rights and do not contain unlawful material.
4. Donations
Donations are processed through a third-party processor (Zeffy). Donations to the Campaign are not tax-deductible. Campaign contributions are subject to Maryland State Board of Elections rules, including contribution limits and donor reporting requirements. By making a donation, you represent that you are a U.S. citizen or lawful permanent resident, you are at least 18 years old, the donation is from your own funds (not a corporation, labor organization, government contractor, or foreign national), and the contribution is not being reimbursed by another person.
5. SMS Messages
If you opt in to receive text messages from the Campaign, you consent to receive recurring automated text messages from Friends of James McQueen. Message and data rates may apply. Text STOP to opt out, HELP for help. Your consent is not a condition of donating, volunteering, or voting. See our Privacy Policy for how we handle the information we collect.
6. Intellectual Property
All content on the Site — including text, graphics, logos, photos, audio, video, and software — is owned by the Campaign or its licensors and is protected by United States and international copyright, trademark, and other laws. Except as expressly permitted, you may not copy, distribute, publicly display, or create derivative works of any portion of the Site without our prior written consent. The candidate name, campaign logo, and slogans are trademarks of the Campaign.
7. Third-Party Links and Services
The Site may link to or embed third-party services (e.g. Zeffy for donations, social-media platforms, video hosts, analytics). The Campaign is not responsible for the content, privacy practices, or availability of those third-party services. Your interactions with them are governed by their own terms and privacy policies.
8. Disclaimers
The Site and its content are provided “AS IS” and “AS AVAILABLE” without warranties of any kind, express or implied, including warranties of merchantability, fitness for a particular purpose, or non-infringement. The Campaign does not warrant that the Site will be uninterrupted, error-free, or free of viruses or other harmful components.
9. Limitation of Liability
To the maximum extent permitted by law, the Campaign and its officers, volunteers, vendors, and affiliates will not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits, revenue, data, or goodwill, arising from your use of, or inability to use, the Site, whether based on warranty, contract, tort, or any other legal theory.
10. Indemnification
You agree to indemnify and hold the Campaign, its officers, volunteers, and vendors harmless from any claim, demand, loss, liability, or expense (including reasonable attorneys’ fees) arising out of your use of the Site, your violation of these Terms, or your violation of any rights of another.
11. Termination
We may suspend or terminate your access to the Site at any time, with or without notice, for any reason, including violation of these Terms.
12. Governing Law
These Terms are governed by the laws of the State of Maryland, without regard to its conflict-of-law principles. Any dispute arising out of or related to these Terms or the Site will be resolved exclusively in the state or federal courts located in Maryland, and you consent to the personal jurisdiction of those courts.
13. Changes to These Terms
We may update these Terms from time to time. The “Last updated” date above reflects the most recent revision. Continued use of the Site after a change constitutes acceptance of the revised Terms.
